Terms
Website Terms of Use
These terms govern access to and use of alphafoxgroup.com, a website operated by Alpha Fox Inc., operating as Alpha Fox Group (“Alpha Fox”, “we”, “us”, or “our”).
1. Acceptance of these terms
By accessing or using this website, you agree to these terms and our Privacy Policy. If you do not agree, do not use the website. You must have the legal capacity to agree to these terms on your own behalf or the authority to bind the organization you represent.
2. Website information and client services
The website provides general information about Alpha Fox, technology consulting, and application development. Website content is not technical, legal, financial, security, or other professional advice for your circumstances. You should not act or refrain from acting solely because of information published here.
An email, contact-form draft, meeting, proposal, or discussion does not by itself create a client relationship or obligate either party to proceed. Any engagement requires a written agreement, statement of work, or other written scope accepted by both Alpha Fox and the client.
The applicable client agreement—not these website terms—will govern services, fees, timelines, confidentiality, warranties, intellectual property in client deliverables, and liability relating to that engagement. If there is a conflict, the client agreement controls for the engagement.
3. Permitted use
Alpha Fox grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the website for lawful informational and business purposes. You may link to public pages and print reasonable extracts for internal reference.
You must not:
- use the website in violation of applicable law or another person’s rights;
- attempt to bypass security, probe for vulnerabilities, disrupt service, or introduce malicious code;
- scrape, harvest, or use automated means to access the website in a manner that burdens its systems;
- misrepresent your identity or affiliation with Alpha Fox; or
- copy, republish, sell, or present substantial website content as your own.
4. Intellectual property
The website and its content—including text, design, graphics, code, the Alpha Fox name, and the fox mark—are owned by or licensed to Alpha Fox and are protected by applicable intellectual property laws. No ownership rights are transferred under these terms.
Rights in software, designs, reports, or other deliverables created for a client are determined solely by the applicable client agreement. Unless that agreement says otherwise, Alpha Fox retains its pre-existing tools, methods, know-how, templates, and other background intellectual property. Third-party and open-source materials remain subject to their respective licences.
5. Third-party services and links
The website may refer or link to third-party websites or services. They are provided for convenience only. Alpha Fox does not control and is not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms.
6. Website availability and changes
We may update, suspend, restrict, or discontinue any part of the website without notice. We do not promise that the website will always be available, uninterrupted, secure, current, or free of errors or harmful components.
7. Disclaimers
To the maximum extent permitted by applicable law, the website and its content are provided “as is” and “as available”, without representations, warranties, or conditions of any kind, whether express, implied, statutory, or collateral. This includes implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability.
Descriptions of services, processes, capabilities, or past application work are general. They do not guarantee that the same approach, functionality, schedule, cost, or result will apply to another organization or engagement.
8. Limitation of liability
To the maximum extent permitted by applicable law, Alpha Fox and its directors, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, business opportunity, goodwill, use, or data, arising from or relating to this website.
To the maximum extent permitted by applicable law, Alpha Fox’s aggregate liability arising from or relating to your use of the website will not exceed the greater of CAD $100 and the amount, if any, you paid Alpha Fox specifically to access the website.
Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited by law. Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Alpha Fox and its directors, officers, employees, and contractors from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these terms, or your infringement of another person’s rights.
10. Privacy
Our Privacy Policy explains how we handle personal information associated with the website and business inquiries. It forms part of these terms.
11. Governing law and disputes
These terms are governed by the applicable laws of Canada and the laws of the province or territory in which Alpha Fox Inc. is incorporated, without regard to conflict-of-law rules. Subject to any rights you may have under mandatory law, disputes relating to these terms or the website will be brought before the courts of that province or territory.
12. General
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These terms and the Privacy Policy are the entire agreement between you and Alpha Fox regarding use of the website.
We may update these terms from time to time by publishing a revised version and changing the effective date. Continued use after an update means you accept the revised terms.
13. Contact
